If you are an overseas national married to someone living in the UK the UK spouse visa may be the route for your to come and live with your partner in the UK.
A spouse visa must be submitted from abroad but can in some cases can be submitted from within the UK if for example you currently hold a visa of more than 6 months duration.
A UK spouse visa entitles an individual to:
- live in the UK with their partner
- take employment, or
- establish themselves in business for so long as their relationship is subsisting.
Your UK spouse
You must be a:
- a British national
- someone granted humanitarian protection
- someone with indefinite leave to remain (settled in the UK) or
- an EEA national with pre-settled status or settled status.
If so your UK spouse can then act as the sponsor for your visa to live and work in the UK.
Legal requirements
Both your sponsor and you must:
- be over the age of 18;
- intend to live together permanently;
- speak and understand English to a minimum level; and
- meet a minimum financial requirement and house themselves.
Financial requirements
Consideration should be given to the financial requirements for a UK spouse visa as depending on your circumstances this can be quite challenging. The current financial requirement since 11 April 2024 is £29,000 per annum which is usually met by showing your partner has this income or can make up a shortfall through holding savings. Please note the £29,000 amount is currently under review. Those who were granted a visa through the pre 11 April 2024 rules can continue to show an income of £18600 per annum.
Route to settlement through the UK spouse visa
The UK spouse visa is a two-part process, the first is the initial application which will be granted for a period of 30 or 33 months (depending on whether it is an in-country or an out of country application).
On completion of this period the second extension application must be made for a further 30 months.
After spending 5 years (60 months) in the UK with a UK spouse visa, you will become eligible for indefinite leave to remain (ILR) and then British citizenship.
